Workplace Violence

No death is as tragic as a life stolen by violence which could have been prevented.  In an average week in U.S. workplaces, one employee is killed and at least 25 are seriously injured in violent assaults by current or former co-workers. (USA Today).  Statistics show that more than 2 million people are victims of violent crime in the workplace. The most frequent type of workplace violent crime is simple assault, with an estimated 1.5 million victimizations occurring each year. In the United States there were 396,000 aggravated assaults, 51,000 rapes and sexual assaults, 84,000 robberies, and 1,000 homicides in the workplace.  Many of the attacks could have been prevented.

Common issues in workplace violence cases involve whether the employer was negligent in hiring the aggressor employee or whether the employer negligently retained the aggressor employee once the employer learned of aggressor’s dangerous nature.  Also common is whether the employer performed a criminal background check or whether the employer performed an adequate background check.
